From 1 September 2007, applicants for a General Skilled Migration (GSM)visa wishing to meet the 2 year study rule will need to have completed aprogram of study with a two (2) year academic workload (16 subjects orequivalent). Two (2) academic years study means the equivalent of two (2)years study enrolled at 100% or a full time load. It is a measure of theamount of study you have completed rather than how long it took you tocomplete the study. Migration to Australia is dependent on an applicant’s ability to meet thelegal requirements set out in the Migration Act and Regulations that arecurrent when the visa application is lodged. These criteria are designed tomeet Australia’s national interest and needs, and in the case of theGeneral Skilled Migration (GSM) programme to ensure that successfulapplicants have the appropriate skills required to assist them to settleand find full-time skilled employment in Australia. The 2005 Evaluation ofthe GSM Visa Categories found there was a need to make some adjustments tothe requirements applicants need to meet in order to achieve this objectiveand the Minister announced in April 2007 that changes would be made. Asthe purpose of the GSM visa categories is to select migrants most likely tohave good employment outcomes there will be many overseas students withgood English skills who have completed a 2 year program of study that willbenefit from the introduction of the changes on 1 September 2007. There will be no 'exemption' granted to students who lodge an applicationon or after 1 September 2007 when the new regulations are in effect if theyare unable to meet the new 2 year study requirement because they arecurrently enrolled in a program of study that is less than 2 academic yearsin length. （很清楚的写着，和ENROLL的时间无关，而是看你什么时候递交申请） A Student visa is a temporary visa and the purpose of this visais to give the holder the opportunity to undertake a program of study at anAustralian educational institution for the award of an Australianqualification. While many overseas students make a decision to apply forpermanent residency in Australia when they complete their studies, there isno guarantee that, because they have held a student visa they will alsomeet the requirements for the grant of a permanent visa. Overseas students concerned they may not be able to meet the new 2 yearstudy rule have the option of enrolling in another course for the award ofa degree, diploma or trade qualification.
